RATES:
Rates are quoted on a per night, per week or per month basis as noted. Unless specified, check-in time is after 4:00 p.m., and checkout by 10:00 a.m. on the day of departure. Rates are based on a specified number of people (4 for 1-bedroom, 6 for 2-bedroom, and 8 for 3-bedroom) occupying the unit(s). Charges and rates may vary and are subject to change without notice. ***If you received the 10% military discount, you will be required to show your ID at check-in. If you do not have your ID, the discount will be removed and your credit card will be charged***.

SECURITY DEPOSIT WAIVER FEES:
A Security Deposit Waiver Fee of $65.00 plus tax is required for each reservation made. If multiple units are being rented, the security deposit waiver fee will be included on each reservation. This charge is non-refundable and will pay for accidental damages in the unit for up to $1000. This fee will pay for only minor, unintentional damages to the rental unit interior and property within the interior of the unit which might occur during your stay. Accidental damages MUST be reported to management before check-out to be considered accidental. Missing items are never considered accidental damage and will not be paid for under this fee. Items not paid for under this fee will be dealt with through conventional methods of charging the guest credit card for the amount of the damages at replacement costs. The security deposit waiver fee will not pay for any damage done to the common areas or property of The Breakers.

DAMAGE DEPOSIT:
Should you opt not to pay the $ 65.00 Security Deposit Waiver Fee, there is a refundable damage deposit of $1500.00 that will be required at time of booking. This damage deposit will also pay for any accidental damages and will be released within 30 days after your departure. Should any damages occur, we will deduct the declared value of the damaged object from the total and release the remaining, if any. The refund process can take 7-10 business days for the funds to be released back to the card originally charged.

Bi-Weekly Clean: 1 Bedroom - $43, 2 Bedroom Standard - $53, 2 Bedroom Deluxe - $58.00, 3 Bedroom 2 Bath - $65, 3 Bedroom 3 Bath - $70 (Bi-Weekly Clean: applied to every reservation that is greater than or equal to 28 nights)

AGE RESTRICTION:
The Breakers does not allow anyone to check-in unless a valid photo ID is given and that person must be 25 or older. The person who's name the reservation is made under has to be 25 years or older and MUST occupy the unit for the duration of the stay. If this rule is not followed, the reservation will be canceled and no monies will be refunded.

PET POLICY:
The Breakers of Fort Walton Beach does NOT allow pets. No Pets will be permitted on property.  If pets are discovered in a unit, there will be additional fees and possible eviction with no monies refunded.

MILITARY & GOVERNMENT CONTRACTORS GUESTS:

The GSA per diem rate is for military or government contractors traveling on official orders. Upon arrival (or when making the reservation) you will need to provide Government Travel Orders. These are also required to qualify for a Tax Exemption. There is a 10% discount for active or retired military personnel that are on leisure travel (terms & conditions apply, please contact The Breakers for more information).


SMOKING POLICY:
As of January 1, 2019 The Breakers will be a NO SMOKING facility. This is to include all forms of tobacco, vaping and e-cigarettes. If smoking is found in units, on balconies, on walkways, pool area or any part of the grounds surrounding The Breakers, there will be additional fees and possible eviction with no monies refunded.

ADDITIONAL CHARGES (NOT INCLUDED IN RATE):
Rates do NOT include bi-weekly maid service (unless noted), excessive cleaning upon departure such as but not limited to upholstery. rug shampooing, etc.), deodorizing/sanitizing of unit if found smoke smell is found. There will be additional fees and will be charged to the credit card on file if imposed.

RESERVATIONS AND PAYMENTS:
A Rental Deposit equal to 35% of the total rent is due upon making the reservation. Final payment, consisting of the full remaining balance, must be received by The Breakers no later than thirty (30) days prior to guest arrival. If booking a reservation within 30 days prior to the arrival date than full payment of reservations is due at time of booking. Failure to make final payments on a timely basis will result in reservation being cancellation.

CONDITION OF RENTAL:
The property shall be in the same condition upon departure as at check-in. Normal wear and tear excepted. Maintenance or housekeeping may enter the unit at reasonable times to make repairs or provide service. Guest must immediately notify the front desk of fire or other damage to property. Guests shall be liable for all acts of the family, invitees, employees, or other persons invited onto the property. Guests may not sublet or assign this rental agreement. Guests shall be responsible to return all keys upon departure. Guests shall abide by the Rules and Restriction of the Condominium Owners Association. Guests shall not bring any pets onto the property. Guests will not smoke indoors or on the Balcony. Guests will rinse feet of sand prior to entering the unit. Guest shall not permit any use of pool by unsupervised children or other guests and shall keep gates closed. Guests and other invitees shall use the pool at their own risk as there is no life guard on site.

LIMITATION OF LIABILITY:
Under no circumstances shall The Breakers be responsible for any loss, expense, damages, claims or injury direct, indirect, consequential or otherwise whatsoever, howsoever caused or incurred whether arising in contract or otherwise in law or equity as a result of rendering of the services or accommodations as described or substituted and including, without restricting the generality of the foregoing as a result of any delay(s), substitution(s), rescheduling(s) or change(s) in the provision of services or land accommodations by The Breakers or by reason of military actions, revolution or acts of God, government agencies, or unforeseen circumstances or events, by any agents, owners, employees, subcontractors, servants or services as substituted; The Breakers, at all times will act in good faith and use its best efforts to substitute with accommodations or services of a type as comparable as possible to those contracted. The Breakers will not be liable under any circumstances, including substitutions, to refund any unused portion of booked accommodations or services. Guests may also encounter the following risks: slippery floors and stairs, especially when wet, lanais with spaces between rails (dangerous for little children), clean/clear sliding glass doors, and dangerous stairs or pathways, Therefore, each guest agrees that he/she is voluntarily participating in any and all activities, risks, and use of the accommodations, and hereby assumes all risk of injury, illness, damage or loss to person and property that might result, including, without limitation, any loss or theft of personal property. By booking this property, you acknowledge that in all events and circumstances, The Breakers and its employees shall not be liable. The Breakers reserves the right to cancel or rescind any rental agreement if it is found that the Guests are conducting unlawful activities, not abiding by the Home Owners Association House Rules, disturbing others by playing loud music, percussion, audio or instruments, or cause any loud or offensive noises, have made any misrepresentations about the nature or size of the group or use of the group or the use of the property or any other misrepresentations or any other way in breach of the rental agreement.

NOTICE OF ABSENCE:
You must tell us in advance if you will be absent from the property for 5 days or more. If you do not give us this notice, you will have to pay for any damage that may result from your absence.

ABANDONED POSSESSIONS AND SERVICE OF NOTICES:
If you leave any personal property, which we determine to be of value, we must contact you by mailing a notice. After 20 days, if you do not respond, we may advertise the items for sale or donate them to a charitable organization. If we have to give any notice to you, we can serve it to any occupant. By serving one of you, we have given notice to all of you. If we cannot deliver a notice to you, we may post the notice in a conspicuous place in or on the unit.

INSURANCE:
You understand that our insurance does not cover your belongings or intentional damage that you cause. You agree that we are not responsible for any loss or damage during the term of the rental agreement. You agree to carry insurance covering all of your personal property located in the unit or bear full responsibility for its damage including damage from fire, water, theft, or any cause.

TRAVEL PROTECTION INSURANCE:
The Breakers of Fort Walton Beach has partnered with Rental Guardian Travel Insurance to provide coverage for our guests. Rental Guardian provides cancellation and interruption services as well as emergency assistance and travel services. Protect yourself in the event of certain hurricane evacuations and most family emergencies such as illness or death in the family. The travel insurance is optional and the cost is 7% of your total reservation stay.
There is an additional insurance option called Cancel For Any Reason. This will allow you to cancel for any reason, the cost is 10.8% of your total reservation stay. Reimbursement will be 60%.

CANCELLATION AND REFUNDS:
Cancellations of rentals that are made more than 30 days prior to the arrival date will forfeit the entire deposit paid. If you cancel within 30 days of your arrival you will forfeit all monies paid. Cancellations or early departures do not warrant any refund of rent or deposit. Travel Insurance is strongly recommended to all guests for their own financial protection. BEACH SERVICE:
Sunset Beach Services provide a full set up for standard paying reservations. This set up includes 2 beach chairs and 1 umbrella (regardless of unit size), which can be claimed beginning at 9AM and will be removed by 5PM (these hours could vary depending on the weather). Any additional chairs, or for unqualifying guests, chairs can be purchased directly from the beach service attendant with cash only. Please be respectful to the beach service attendants, as they work very hard to provide this service for you. Any reports of improper behavior to the beach attendant could result in refusal of this service with no prior warning.
